The California Designated Representative Experience Affidavit specifies what kinds of work experience will be recognized and accepted. Pay close attention to some of the operative words and phrases that are used, such as:
  • paid work experience 
  • minimum of one year experience 
  • one year of paid work experience in the past three years 
  • in a licensed facility
Some of the experience requirements are different, depending upon your selected personal license. Therefore, be sure to reference the personal license application you're applying for (wholesaler; 3PL; reverse distributor) in the experience affidavit form/section.

The training affidavit is proof of required training.

In general, individuals applying for a designated representative license in California must submit proof that they have completed required training as specified on their applicable license application Training Affidavit form.

The three (3) most common Training Affidavit forms include: 1) wholesaler, 2) 3PL (third-party logistics provider), and 3) wholesaler only acting as a reverse distributor. Each specific Training Affidavit form is unique, and they are not interchangeable.

Training programs approved by the California State Board of Pharmacy (the "Board") should be providing their students with a completed and signed copy of the applicable Training Affidavit form. The Board will not accept a Training Affidavit that is filled out by someone other than the training program provider.

HOT TIP:  The Training Affidavit Is Not The Same As The Experience Affidavit

These are two different forms. In general, the Experience Affidavit form attests that the work experience gained by the applicant meets the requirements as required by law.

What is a California pharmacy DRIC?

DRIC means Designated Representative-in-Charge

Here is the full answer, in the context of a wholesaler facility (according to the California wholesaler facility license application).

A wholesaler facility must have its own DRIC responsible for the operations of the wholesaler. The application must list one designated representative, designated representative-reverse distributor, or a pharmacist to serve as the DRIC. If the wholesaler acts only as a reverse distributor participating in the California Drug Take-Back Program, a designated representativereverse distributor or California licensed pharmacist shall serve as the DRIC. The proposed DRIC shall be subject to approval by the board. The board shall not issue a wholesaler license without an approved DRIC for the wholesaler. 

The DRIC serves as supervisor or manager who is responsible for ensuring the wholesaler’s compliance with all state and federal laws and regulations pertaining to the wholesale operations. The DRIC shall maintain an active license as a designated representative, designated representative-reverse distributor or pharmacist with the California board at all times during which he or she is designated as the DRIC. (Business and Professions Code section 4160).

Is a California Exemptee the same as a California Designated Representative?

Question: Is a California Exemptee the same as a California Designated Representative?

Answer

No, they are not the same. There is often confusion between the two.

A 2006 California law change started the confusion. This snippet comes from an old 2012 version of the California Designated Representative application: "Note: Under California law, the name used to describe any individual who is in charge of any wholesale drug premises (in California or elsewhere) will change on January 1, 2006, from the former name, exemptee, to designated representative. 

For conventional use, the Board will refer to such an individual as a designated representative throughout this application." Therefore, the California State Board of Pharmacy uses the current name, Designated Representative. 

To add more confusion, an Exemptee personal license does exist.

However, it is administered by the California Department of Public Health (CDPH) - Food and Drug Branch (FDB) and applies to home medical device retailers (HMDR).  An HMDR facility typically needs to employ an individual(s) holding an Exemptee personal license.
